Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Analog mobile application ("Analog", the "App"), our website at turnanalog.com, and related services (together, the "Services") provided by Analog Wellbeing Inc. ("we", "us", "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Privacy

Our Privacy Policy describes how we collect and use information. By using the Services, you acknowledge our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use the Services. The Services carry a 17+ App Store age rating and are not directed to minors.

3. Your Account

Some features require an account. You sign in with Apple and are responsible for maintaining access to your Apple ID and for activity under your account. One account per person. You may not impersonate others or create an account on someone else's behalf without authorization.

4. The Services

Analog provides tools and insights to help you understand and manage your digital habits and — if you choose to use them — social features such as Friends, friend invites, benchmarks, and standings that let you compare your progress with others. The Services may change over time, and we may add, modify, or remove features at any time.

5. Subscriptions and Purchases

The App may offer paid subscriptions or other purchases.

A. Billing

Purchases are processed by the platform provider (Apple's App Store), subject to its terms; you authorize the platform to charge your payment method.

B. Auto-renewal and cancellation

Auto-renewing subscriptions renew unless you cancel through your platform account settings before the renewal date.

C. Price changes and availability

Prices, promotions, and availability may change; we or the platform provider will notify you where required.

D. Refunds

Refunds are handled by the platform provider under its policies.

6. Acceptable Use

You agree not to:

  • Use the Services in any unlawful, harmful, or abusive manner
  • Interfere with or disrupt the Services or circumvent any access controls
  • Reverse engineer, decompile, or attempt to extract source code except as permitted by law
  • Use the Services to infringe or violate the rights of others
  • Probe, scrape, or attempt to enumerate other users, the contact-matching system, or the social graph

We may suspend or terminate access if we reasonably believe you have violated these Terms.

7. Social Features and User Conduct

If you use Friends and related features, you also agree:

  • Your display handle must not impersonate another person or brand, contain unlawful, hateful, harassing, or sexually explicit content, or mislead other users. We may reject, reset, or reclaim handles.
  • You will not harass, stalk, threaten, or abuse other users, or use contact discovery or invites to contact people who do not want to be contacted.
  • You will not use the Services to surveil another person or to identify another user's private information.
  • You can block or remove other users, and we provide a way to report abuse. We may remove content, restrict features, suspend, or terminate accounts that violate these rules, and we may act on reports at our discretion.

There is no tolerance for objectionable content or abusive users on Analog. We review reports and act on them, including removing content and terminating the accounts of users who post objectionable content or behave abusively.

8. Display Handle and User Content

You retain ownership of content you provide (such as your display handle). You grant us a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate the Services (for example, showing your handle and standing to friends you connect with). You are responsible for the content you provide and represent you have the right to provide it.

9. Notifications

If the App offers notifications, you can enable or disable them in your device settings; some features may not work as intended if notifications are disabled.

10. Third-Party Services and Links

The Services may interact with or link to third-party services (including platform providers). We are not responsible for third-party services; your use of them is subject to their terms.

11. Intellectual Property; License

The Services — including content, software, and design — are owned by us or our licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

12. Data Processing and Aggregate Statistics

As described in our Privacy Policy, we process your screen-time and usage data (not your Apple Health data, which stays on your device) to operate the Services and generate insights for you. If you opt in to contribute to comparisons, you grant Analog Wellbeing Inc. a non-exclusive, royalty-free, worldwide license to include that usage data in group-level comparison statistics, published only where no individual is identified. Apple Health data is excluded from this license and is never used for aggregates or model training under these Terms. You can revoke your contribution in the app at any time; revocation applies going forward and does not affect already-published group statistics.

13. Feedback

If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ANALOG IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL, MENTAL-HEALTH, OR OTHER PROFESSIONAL ADVICE; INSIGHTS DERIVED FROM SCREEN-TIME OR APPLE HEALTH DATA ARE FOR INFORMATIONAL AND WELLBEING PURPOSES ONLY. YOU ARE RESPONSIBLE FOR HOW YOU USE THE SERVICES. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANALOG WELLBEING INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU HAVE NOT PAID ANY AMOUNTS, US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Analog Wellbeing Inc. from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or your violation of these Terms.

17. Termination

You may stop using the Services at any time, including by deleting your account. We may suspend or terminate your access if we believe you have violated these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive (including Sections 8, 11–16, 18–20, and 22).

18. Apple App Store (additional terms)

These Terms are between you and Analog Wellbeing Inc., not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranties, whether express or implied. Apple is not responsible for addressing any claims relating to the App (including product-liability, legal/regulatory, or consumer-protection claims) or any third-party intellectual-property claim. You must comply with applicable third-party terms (for example, your wireless data-plan terms). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a US-embargoed country or on a US prohibited-parties list.

19. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts located in Toronto, Ontario have non-exclusive jurisdiction over any disputes. Nothing in these Terms limits any non-waivable rights you have under the laws of the jurisdiction where you reside, including the right to bring a claim in small-claims court in your jurisdiction.

20. General

  • Severability. If any provision is found unenforceable, the rest of the Terms remain in effect, and the unenforceable provision is modified to the minimum extent necessary.
  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services and supersede prior agreements.
  • Assignment. You may not assign these Terms without our consent; we may assign them (for example, in a merger or sale of assets).
  • No Waiver. Our failure to enforce a provision is not a waiver of it.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices. We may provide notices through the App, by email, or by posting on the website.

21. Changes to These Terms

We may update these Terms; we will update the "Effective date" above and, for material changes, provide additional notice as required by law. Continued use after changes become effective means you accept the updated Terms.
